CHAPTER 49

AREA 3

1998-1999

 

Section 1. Authority. These rules are promulgated by the authority of Wyoming Statutes 23-1-302, 23-2-206, 23-3-201 and 23-3-202.

Section 2. General Fishing Rules. The provisions of General Fishing Rules (Chapter 46) apply except as specified below.

Section 3. Area 3. Coverage. Area 3 includes the Niobrara River, Cheyenne River, Stockade-Beaver Creek, Sand Creek, Belle Fourche River, Little Missouri River, Little Powder River, Powder River, Tongue River, and Little Bighorn River Drainages.

Section 4. Seasons. Fishing is permitted in Area 3 during the entire calendar year except as specified differently below:

(a) That portion of Shell Creek, Johnson County, lying west of the Game and Fish markers to a designated point above the state spawning trap is closed to fishing from March 1 through May 31.

(b) Leiter Ditch from 50 feet either side of its mouth in Lake DeSmet upstream to the Leiter Ditch Pond is closed to fishing year round.

(c) Burlington Reservoir in Natrona County shall be closed from September 1 through April 30.

Section 5. Creel Limits, Length Limits, Tackle Restrictions on Specific Waters. The general creel limits (Chapter 46, Section 5) and legal fishing methods apply in Area 3 except as specified differently below:

(a) Bull Creek, Sheridan County. All trout (except brook trout) must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only.

(b) Healy Reservoir, Johnson County. The limit on trout shall be two per day or in possession. All trout greater than 15 inches must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only.

(c) Lake DeSmet, Johnson County. The limit on trout shall be four per day or in possession. Only one trout may exceed 15 inches.

(d) Little Big Horn River (including all tributaries), Sheridan County, from the mouth of Dayton Gulch Creek upstream. All trout (except brook trout) must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only.

(e) Middle Fork of Powder River, Johnson County, from the Bar C Road (Johnson County Road 238) on the Bar C Ranch Upstream to Bachaus Creek. The limit on trout shall be six per day or in possession. Only one trout may exceed 16 inches, and all trout between 10 and 16 inches (inclusive) must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only.

(f) Muddy Guard Reservoir No. 1, Johnson County. The limit on trout shall be two per day or in possession. All trout less than 18 inches must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only.

(g) North Tongue River (including all tributaries), Sheridan County, from the Mouth of Bull Creek upstream. All trout (except brook trout) must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only.

(h) Sand Creek, Crook County, from Interstate 90 upstream through Ranch "A" to the forest service boundary. The limit on brown trout is 12 per day or in possession. Only one may exceed 12 inches. All other trout must be returned to the water immediately. Fishing is permitted by the use of artificial flies and lures only on the Ranch "A" public fishing area.

Section 6. Special Winter Ice Fishing Regulation. There shall be a special winter ice fishing regulation (Chapter 46, Section 2B) during the ice covered period on the following water:

(1) Keyhole Reservoir in Crook County.

Section 7. Live Bait Fish. The use or possession of live bait fish in Area 3 is prohibited except as specified below.

(a) Live bait fish may be used for bait in Keyhole Reservoir, the Belle Fourche River proper, Tongue River from Interstate Highway 90 to the Wyoming-Montana state line, and Goose Creek from Interstate Highway 90 to its confluence with Tongue River, provided such bait fish are obtained from a licensed bait dealer authorized to sell fish for use in these waters.

(b) A holder of a valid seining license may seine or trap live bait fish in Area 3 for use as specified below.

(1) Live bait fish seined or trapped in Keyhole Reservoir or the Belle Fourche River Drainage may be used only in those waters.

(2) Live bait fish seined or trapped in the Tongue River may be used only in the Tongue River from Interstate Highway 90 to the Wyoming-Montana state line, and in Goose Creek from Interstate Highway 90 to its confluence with the Tongue River.

Section 8. Spear Gun Fishing. Underwater spear gun fishing is permitted in Lake DeSmet and Keyhole Reservoir from June 1 through August 31. The limit on walleye in Area 3 shall be 2 fish per day or in possession. All other general and specific water creel limits apply.
